The Penalties For Drinking And Driving In Iowa
An arrest on an OWI charge is serious, even if you have no prior record. Iowa law categorizes a first offense for OWI as a “serious misdemeanor” with a mandatory minimum sentence of 48 hours behind bars or under law enforcement supervision in an OWI program.
You could also be ordered to pay a fine of up to $1,250 and lose your driver’s license for any length of time between 180 days and one year. Finally, you could have to undergo evaluation for drug or alcohol addiction and attend a substance abuse prevention course.
The more prior OWIs you have on your record, the heavier the potential punishments for a new conviction will be. A second offense could send you to jail for between seven days and two years and fines of up to $6,250. Your license could be suspended for up to six years. Once you get your driving privileges back, the court could require you to install an ignition interlock device into your car.
What We Do About OWI Charges
Remember that an arrest does not automatically mean a conviction. One of our lawyers will closely scrutinize the case against you for possible mistakes, such as improper use of a breath test device or field sobriety tests. We will represent you at all hearings and work to get the charges against you reduced or dismissed outright.
We know how an OWI conviction can harm your career, your independence and your reputation with family and friends. We are not here to judge you if you have made a mistake. Our job is to serve as your advocate throughout the process and resolve the issues for you as effectively as possible.
